Instead, it applies only to specific types of threats involving serious public safety risks, violence, weapons, or evacuation scenarios.<\/span><\/p>\n<h2>When Does a Threat Become First-Degree Threatening?<\/h2>\n<p><span style=\"font-weight: 400;\">Bajo <\/span><a href=\"https:\/\/www.cga.ct.gov\/current\/pub\/chap_952.htm#sec_53a-61aa\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">C.G.S. \u00a7 53a-61aa<\/span><\/a><span style=\"font-weight: 400;\">, a person may be charged with Threatening in the First Degree if they engage in one of the following types of conduct:<\/span><\/p>\n<h3>1. What are Threats Involving Hazardous Substances or Violent Crimes?<\/h3>\n<p><span style=\"font-weight: 400;\">A person commits the offense if they:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Threaten to commit a crime involving a hazardous substance, or<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Threaten to commit a crime of violence,<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">and do so:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">With the intent to cause evacuation of a building, place of assembly, or public transportation facility, or<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">With intent to terrorize another person, or<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In reckless disregard of the risk of causing evacuation or serious public inconvenience or terror.<\/span><\/li>\n<\/ul>\n<h3>2. Threatening Connected to Second-Degree Threatening with a Firearm<\/h3>\n<p><span style=\"font-weight: 400;\">A person may also be charged if they:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Commit Threatening in the Second Degree (C.G.S. \u00a7 53a-62), and<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">During the offense, they:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Use or are armed with a firearm, or<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Display or represent (by words or conduct) that they possess a firearm such as a pistol, revolver, shotgun, rifle, or machine gun.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3>3. What about Threats Targeting Sensitive Public Locations?<\/h3>\n<p><span style=\"font-weight: 400;\">The statute also applies when a person violates the above provisions with intent to cause evacuation of certain protected locations, including:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Houses of religious worship<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Religiously affiliated community centers<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Public or private schools (including preschools and higher education institutions)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Day care centers during operational or program hours or related activities<\/span><\/li>\n<\/ul>\n<h2>What is a Hazardous Substance?<\/h2>\n<p><span style=\"font-weight: 400;\">Under the statute, a hazardous substance includes any physical, chemical, biological, or radiological material that may:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Cause or significantly contribute to death or serious illness, or<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Pose a substantial present or potential risk to human health due to its properties or concentration.<\/span><\/li>\n<\/ul>\n<h2>Which Common Situations May Lead to a Threatening Charge?<\/h2>\n<p><span style=\"font-weight: 400;\">Threatening in the First Degree applies only in specific circumstances.
